These Terms of Service ("Terms") govern your use of tribehq.co (the "Site"), your membership in TRIBE, and your attendance at TRIBE events. They are an agreement between you and TRIBE ("TRIBE," "we," "us," or "our"), located at 4034 Endurance Trl, Wilmington, NC 28412.
By using the Site, submitting a form, or joining TRIBE, you agree to these Terms and to our Privacy Policy, which explains how we handle your information. If you do not agree, please do not use the Site or join.
1. Who may use TRIBE
You must be at least 18 years old and able to enter a binding contract. TRIBE is built for founders and operators running established businesses. Membership is by application, and applying does not guarantee acceptance.
2. Applications
We review every application personally and may accept or decline any application for any lawful reason. You agree that the information you give us is accurate and that you will keep it current. We may decline or revoke membership if information you provided turns out to be materially inaccurate.
3. Membership, fees, and renewal
Membership is an annual commitment. Current pricing is shown on our pricing page and is confirmed to you before you are charged. You may pay for the year upfront or quarterly, as described there.
- One-year commitment. Membership runs for a full year from your start date. If you pay quarterly, you remain responsible for the remaining quarterly payments for that year.
- No refunds. Membership fees are non-refundable. We keep the bar high on the way in specifically so this rarely matters.
- Changes to pricing. We may change pricing for future terms. Any change will be communicated before your renewal, and it will not alter the price of a term you have already begun.
- Late or failed payments. We may suspend access to member benefits if a payment fails and is not resolved after we contact you.
Any value guarantee we offer is described where it is presented, and its full terms are provided with your acceptance. Where those terms and these Terms differ on that specific subject, the guarantee terms control.
4. Events, retreats, and the Summit
TRIBE runs chapter meetups, retreats, and an annual Summit. Tickets, registrations, and room blocks are governed by the terms presented at the time of purchase or registration. Travel and lodging are your responsibility unless we state otherwise in writing.
We may change or cancel an event, change speakers or programming, or change a venue. Announced speakers are subject to change and are not a guarantee of attendance. If we cancel an event outright, we will tell you what happens to your registration at that time.
By attending a TRIBE event you agree that we may photograph or record the event and use those images and recordings in our marketing. Tell us in writing if you would rather not appear, and we will do our best to accommodate that.
5. Community conduct
The room only works if people protect it. As a member or guest, you agree to:
- Not pitch. TRIBE is not a place to sell to other members. No pitching, ever. This is the rule we enforce most strictly.
- Keep it confidential. What members share in meetings, retreats, Slack, and events stays in the room. Do not repeat, publish, or forward another member's private information or business details without their permission.
- Give first. Show up in good faith, contribute honestly, and treat other members with respect.
- Not harass anyone. Harassment, discrimination, threats, and abusive behavior have no place here.
- Not scrape or misuse the member directory or any member contact information, including for bulk outreach, recruiting solicitations, or adding people to mailing lists.
We may remove any member who violates these expectations. Removal for conduct does not entitle you to a refund.
6. No professional advice
This one matters, so read it closely. TRIBE is a peer community. Members, mentors, and speakers share their own experience and opinions. Nothing said in the community, at an event, in Slack, on this Site, or in any TRIBE material is legal, financial, tax, accounting, investment, medical, or other professional advice. No attorney-client, fiduciary, or other professional relationship is created by your membership or by any conversation within it.
Business decisions you make are yours. Consult your own qualified professionals before acting. TRIBE does not guarantee any business result, revenue outcome, or return on your membership, and any results described by members are their own and not typical.
7. Your content
If you submit a review, testimonial, photo, or other content to us, you keep ownership of it and grant TRIBE a non-exclusive, worldwide, royalty-free license to use, reproduce, and display it in connection with promoting TRIBE. You confirm you have the right to give us that license and that the content is truthful and does not infringe anyone else's rights. We may decline to publish or may remove any submission.
8. Our content
The Site and its content, including text, graphics, logos, photographs, video, playbooks, and other materials, belong to TRIBE or our licensors and are protected by intellectual property law. Member resources are provided for your own use as a member. You may not copy, republish, resell, or distribute them outside the community without our written permission. The TRIBE name and logo are our marks and may not be used without permission.
9. Acceptable use of the Site
You agree not to interfere with the Site's operation or security, attempt to gain unauthorized access to any system, scrape or harvest data by automated means, upload malicious code, or use the Site for any unlawful purpose.
10. Communications
By providing your email address you agree we may send you messages about your application, membership, and events. Marketing emails include an unsubscribe link. If you opt into SMS, you may reply STOP at any time to stop receiving texts. Message frequency will vary, message and data rates may apply, and carriers are not liable for delayed or undelivered messages. Full details are in our Privacy Policy.
11. Third-party links and services
The Site links to third-party websites and uses third-party services. We do not control them and are not responsible for their content, products, or practices. Your dealings with them are between you and them.
12. Disclaimers
The Site, membership, and events are provided "as is" and "as available." To the fullest extent permitted by law, TRIBE disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, secure, or error-free. We are not responsible for the acts, omissions, statements, advice, or conduct of other members or of third-party speakers and partners.
13. Limitation of liability
To the fullest extent permitted by law, TRIBE and its officers, members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, or lost data, arising out of or related to these Terms, the Site, your membership, or any event, whether based in contract, tort, or any other theory, even if we have been advised of the possibility.
Our total liability for any claim arising out of or related to these Terms, the Site, your membership, or any event will not exceed the amount you paid TRIBE in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless TRIBE and its officers, members, employees, and contractors from any claims, damages, liabilities, and expenses, including reasonable attorneys' fees, arising from your use of the Site, your participation in the community or at events, your content, or your violation of these Terms or of any law or third-party right.
15. Termination
You may stop using the Site at any time. Membership terms are described in Section 3. We may suspend or terminate your access to the Site or the community at any time for violation of these Terms or for conduct that harms the community. Sections that by their nature should survive termination will survive, including Sections 6 through 8 and 12 through 17.
16. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. You and TRIBE agree that any dispute arising out of or relating to these Terms, the Site, your membership, or any event will be brought exclusively in the state or federal courts located in New Hanover County, North Carolina, and you consent to the personal jurisdiction of those courts.
Before filing anything, you agree to contact us at marketing@tribehq.co and give us 30 days to resolve the issue directly. Most things get solved with a conversation.
17. General
These Terms, together with our Privacy Policy and any membership or event terms we provide, are the entire agreement between you and TRIBE on this subject. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
18. Changes to these Terms
We may update these Terms. We will revise the "Last updated" date above, and for material changes we will provide additional notice. Continuing to use the Site or your membership after a change means you accept the updated Terms.
